The medical community of Ukraine expresses concern about the situation surrounding oncologist Vitaliy Rusakov, who is under criminal proceedings on suspicion of improper performance of professional duties. This case has caused significant resonance, as it is seen as a manifestation of the trend towards criminalization of medical activities without proper professional assessment.
Medical practice is a highly complex field, where decisions are made under critical conditions, and the outcome is not always predictable even when clinical standards are met. Criminal assessment of medical actions without independent expertise creates risks of undermining trust in justice and creating an atmosphere of fear among doctors, which negatively affects the quality of medical care.
An important element of the modern healthcare system is medical professional liability insurance. It allows for civilized resolution of potential conflicts between a doctor and a patient, provides compensation in the event of proven error, and at the same time protects medical professionals from unfounded accusations.
Our Organization emphasizes the need for intersectoral cooperation — between doctors, lawyers, the Ministry of Health, professional associations, insurance structures, and public organizations. Such an approach will contribute to the formation of a balanced system that guarantees fair protection of the rights of both doctors and patients.
